Return Policy for Prescription Medications Effective Date: 09/30/2025 Zenith Health RX - Form This Return Policy is established in strict compliance with all applicable federal and state laws and regulations governing the dispensing, handling, and return of prescription medications. By purchasing prescription medications from Zenith Health RX, the patient acknowledges and agrees to the terms and conditions outlined in this policy. Non-Returnable Prescription Medications In accordance with the U.S. Food and Drug Administration (FDA) policy on drug returns and reprocessing (21 CFR § 205.50), Zenith Health RX does not accept returns or issue refunds for prescription medications once they have been dispensed and delivered to the patient. This policy is in place to protect patient safety, maintain medication integrity, and ensure compliance with federal and state regulatory requirements. Per the FDA’s guidelines on returned drugs, prescription medications cannot be returned once they have left the control of the dispensing pharmacy because such returns may introduce contamination, improper storage conditions, or potential tampering. Patients are strongly encouraged to review their prescriptions carefully before dispensing and shipment to ensure order accuracy. Any concerns must be reported to Zenith Health RX’s customer service team prior to dispensing. Exceptions to the Return Policy While Zenith Health RX cannot accept medication returns, we are committed to working with every patient to resolve any issues in a timely manner, as patient satisfaction is our top priority. Exceptions may be considered under the following circumstances: 1. Dispensing Errors If an error occurs due to Zenith Health RX or its affiliated dispensing pharmacy—such as the incorrect medication, dosage, or labeling—patients may be eligible for a resolution. The patient must notify Zenith Health RX within seven (7) calendar days of receiving the incorrect medication. The patient must provide supporting documentation, including: Photographs of the received medication, including packaging and labeling. Proof of purchase. Any relevant correspondence regarding the prescription. Zenith Health RX - Form Upon verification of the error, Zenith Health RX will coordinate with the dispensing pharmacy to correct the issue. Possible resolutions include: Replacement of the medication with the correct prescription. Correction of labeling discrepancies. Other remedial actions as deemed appropriate under federal and state regulations. 2. Damaged or Compromised Shipments If a prescription medication arrives damaged or compromised in transit: The patient must report the issue within seventy-two (72) hours of delivery. The report must include: A detailed description of the damage or suspected compromise. Clear photographic evidence of the outer packaging, medication container, and contents. Any additional requested documentation. Zenith Health RX will investigate the claim in collaboration with the dispensing pharmacy and shipping provider. If the claim is substantiated, we will determine the most appropriate resolution, which may include medication replacement or another corrective action as permitted by law. Legal Compliance and Patient Responsibilities This Return Policy is developed in compliance with: U.S. Food and Drug Administration (FDA) regulations, including 21 CFR § 205.50 governing the return and redistribution of prescription medications. State Board of Pharmacy requirements on safe medication handling and patient protection. Drug Enforcement Administration (DEA) regulations (if applicable). Patient Responsibilities Patients must ensure that all personal and prescription details are accurate before placing an order. Zenith Health RX- Form Zenith Health RX is not responsible for medication mishandling, improper storage, or noncompliance with prescribed usage once a medication has been dispensed and delivered.     Informed Consent to Telehealth Services This Informed Consent to Telehealth Services ("Consent") is entered into by and between the undersigned patient ("Patient") and Zenith Health RX, a healthcare service provider offering telehealth-based weight loss treatment services, including but not limited to the prescription and management of GLP-1 medications. Please read this Consent carefully before signing. 1. Consent to Telehealth I hereby voluntarily consent to participate in telehealth services with Zenith Health RX and its affiliated medical providers. I understand that telehealth involves the delivery of healthcare services using electronic communications, information technology, or other means between a healthcare provider and a patient who are not in the same physical location. Telehealth services may include, but are not limited to: Evaluation and diagnosis of my health condition. Review of medical history and/or laboratory results. Prescription of medications, including GLP-1 receptor agonists. Ongoing management of prescribed therapies. Communication via secure messaging, video conferencing, telephone, or other digital means. I understand that the use of telehealth is voluntary and that I may seek in-person care at any time. I also acknowledge that certain conditions may require a physical examination or in-person visit, which telehealth cannot provide. 2. Nature of GLP-1 Medications and Informed Consent GLP-1 receptor agonists, including but not limited to Semaglutide and Tirzepatide, are medications that mimic the glucagon-like peptide-1 hormone to regulate blood sugar levels, promote satiety, and reduce appetite. These medications are commonly used off-label for weight loss in patients with or without diabetes. I understand that: The prescribing provider has evaluated my medical history and, in their professional judgment, has determined that I may be a candidate for this treatment. Some medications may be compounded and are not reviewed or approved by the FDA. These are prepared in FDA-registered 503B outsourcing facilities or 503A pharmacies in accordance with state and federal law. Treatment with GLP-1 medications may have known and unknown risks, and I am voluntarily assuming these risks. 3. Potential Side Effects and Risks I acknowledge that I have been informed of and understand the possible adverse effects and risks associated with the use of GLP-1 medications, which may include, but are not limited to: Gastrointestinal symptoms: Nausea, vomiting, diarrhea, constipation, abdominal pain, bloating Pancreatitis: Inflammation of the pancreas, which may be serious or life-threatening Gallbladder disease: Including gallstones or cholecystitis Kidney injury: Dehydration due to gastrointestinal effects may lead to kidney problems Hypoglycemia: Particularly if taken with other glucose-lowering agents Thyroid tumors: Including medullary thyroid carcinoma (MTC); GLP-1 medications are contraindicated in patients with a personal or family history of MTC or MEN 2 Allergic reactions: Rash, difficulty breathing, or swelling of the face/tongue/throat Injection site reactions: Redness, itching, pain, or swelling Mental health effects: Mood changes, including depression or thoughts of self-harm (though rare) I understand that these medications are not appropriate for everyone and should not be used during pregnancy or while breastfeeding unless advised by a provider. 4. Alternatives and Patient Responsibility I understand that alternatives to GLP-1 treatment may include lifestyle modifications, nutritional counseling, other medications, or in-person medical evaluations. I have had the opportunity to ask questions and am satisfied with the responses provided. I agree to: Follow my provider's instructions and prescribed dosing regimen. Promptly report any side effects or new symptoms. Seek emergency medical attention when appropriate. Maintain a relationship with a primary care provider for ongoing comprehensive care. 5. Privacy and Data Security I understand that my information will be protected in accordance with the Health Insurance Portability and Accountability Act (HIPAA). Telehealth platforms used by Zenith Health RX are encrypted and secure. However, I acknowledge that no system is 100% secure and there remains a small risk of unauthorized access. 6. Pharmacy and Dispensing Disclosure Prescriptions may be filled by compounding pharmacies that are not FDA-approved for the specific compounded drug formulations provided. However, these facilities are licensed and regulated at the federal and/or state level and are subject to applicable quality and safety standards. 7. Right to Refuse or Withdraw I may refuse to participate or withdraw my consent to telehealth services at any time without affecting my right to future care or treatment. However, I understand that withdrawal of consent may result in termination of telehealth services, including access to prescribed medication. 8. Telehealth Limitations and Medical Emergencies I understand that: Telehealth services are not appropriate for medical emergencies. In case of emergency, I should call 911 or go to the nearest emergency room immediately. Technical failures may occur that could disrupt telehealth services. Zenith Health RX providers cannot guarantee that telehealth services will be effective for my condition. The inability to conduct a physical examination may limit the provider's ability to diagnose certain conditions. 9. No Guarantee of Results I understand that: Zenith Health RX makes no guarantees regarding weight loss results or treatment outcomes. Individual results may vary significantly based on numerous factors including adherence to treatment, individual metabolism, lifestyle factors, and genetic predisposition. The effectiveness of GLP-1 medications varies among individuals and some patients may not experience significant weight loss. 10. Limitation of Liability TO THE FULLEST EXTENT PERMITTED BY LAW: Zenith Health RX, its affiliates, officers, directors, employees, agents, and contracted healthcare providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to the telehealth services or prescribed medications. The total liability of Zenith Health RX for any claims arising from or related to this agreement shall not exceed the total amount paid by the patient for services in the twelve (12) months preceding the claim. Zenith Health RX shall not be liable for any acts or omissions of third-party pharmacies, laboratories, or other healthcare providers not directly employed by Zenith Health RX. 11. Indemnification I agree to indemnify, defend, and hold harmless Zenith Health RX, its affiliates, and their respective officers, directors, employees, agents, and contracted providers from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to: My breach of this Consent or any representation made herein My misuse of prescribed medications My failure to follow medical advice or treatment protocols My provision of false or incomplete medical information My failure to seek appropriate emergency care when indicated 12. Arbitration Agreement Any dispute, claim, or controversy arising out of or relating to this Consent, the telehealth services, or prescribed treatments shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted by a single arbitrator and shall take place in the state where Zenith Health RX maintains its principal place of business. Each party shall bear its own costs and attorneys' fees, unless otherwise awarded by the arbitrator. I understand that by agreeing to arbitration, I am waiving my right to a jury trial and my right to participate in a class action lawsuit. 13. Governing Law This Consent shall be governed by and construed in accordance with the laws of the state in which Zenith Health RX maintains its principal place of business, without regard to its conflict of law provisions. 14. Severability If any provision of this Consent is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. 15. Entire Agreement This Consent constitutes the entire agreement between the parties regarding the subject matter hereof and supersedes all prior or contemporaneous agreements, understandings, and communications, whether written or oral. 16. Acknowledgment and Binding Agreement By accepting these terms electronically or proceeding with treatment, I acknowledge and agree that: I have read and fully understand this Consent to Telehealth and GLP-1 Medication Treatment. I understand the potential benefits and risks associated with GLP-1 medications. I have had the opportunity to ask questions, and all my questions have been answered to my satisfaction. I am voluntarily entering into this agreement and assuming all risks associated with the treatment. This consent shall remain in effect for the duration of my treatment with Zenith Health RX unless revoked in writing. My electronic acceptance of this Consent has the same legal force and effect as a handwritten signature
